Topic: EHS Professional in Jail. The future of EHS Liability?
In the last decade we have seen an increasing trend towards government criminal prosecution of what historically have been a regulatory violation and/or civil matter. These are incidents and accidents that have resulted in personnel, including EHS personnel, being criminally charged and prosecuted. While historically this was primarily only with environmental matters, the frequency of this criminal prosecution in regards to health and matters has increased to an extent to be very noticeable. In this talk we will focus on:
• Some of the cases and examples of recent prosecutions of EHS personnel;
• The elements of a criminal prosecution;
• Recognition of criminal exposure; and,
• Criminal risk management.
Speaker: Neil Feldscher, CIH,CSP, Esq.
Neil Feldscher is the Chief, Environmental Health & Safety Programs for the Bureau of Engineering Design and Construction (BEDC) of the New York City Department of Environmental Protection (DEP). Neil previously worked as an industrial hygiene, health and safety, and environmental consultant and expert witness. He is an AIHA Fellow and has written and lectured on the aspects of experts and their work in the legal arena, environmental law, ethics, personal liability issues, and the incorporation of EHS into design and construction services.
